MAYOR’S MONTHLY REPORT
NOVEMBER 2008

POLICE: Arrests: Total Adult Arrests 57; Total Juvenile Arrests 8; Summons/Citations Issued 7. Incidents: Total Calls 1,697; Security Checks Performed-Residences & Business Locations 222; Incident Cases Reported 64; Crimes Against Property Reported 96; Crimes Against Persons Reported 80; Accident Reports 95; Traffic Citations Issued 131; Alarms 100; Miles of Road Patrol (Mileage from previous month) 46,608. Officers: Compensatory Hours Used 245.1; Sick Hours Used 238.3; Personal Hours Used 24.0; Compensatory Hours Earned 802.1; Overtime Hours Earned 339.0.

TRAFFIC CONTROL: The MPD issued a total of 131 traffic citations, this being 13 less than same time last year. The MPD made 13 arrests for OVI, this being the same as last year. Radar citations totaled 5, this being 7 less than same time last year. The MPD handled a total of 95 traffic accidents, this being 9 less than same time last year. There were 62 property damage accidents, 20 accidents that occurred on private property and no fatal accidents. Of the above accidents, there were 12 hit-skip accidents, there were 2 accidents that occurred as a direct result of alcohol and/or drugs. There were no pedestrian and no bicycle accidents. There were no motorcycle accidents. The MPD investigated 13 accidents involving a juvenile that resulted that resulted in 4 injuries. There were 57 motor vehicles towed by the MPD, this being 28 less than same time last year. Of the above tows, 29 vehicles were towed from traffic accidents, 3 for traffic offenses of some type, 17 as a direct result of an arrest, 6 for parking violations and there were 2 stolen/recovered vehicles. The traffic officer issued 5 parking citations. The traffic officer was able to mail 0 certified letters in regards to junk and/or abandoned motor vehicles. The traffic officer mailed 3 title searches to the state of Ohio, Bureau of Motor Vehicles. The traffic officer was able to junk or title 3 motor vehicles. The traffic officer issued or acted upon 9 notices (48/72 hour and/or 10/20 day notices). The traffic officer sent numerous 2255s and driver’s licenses to the state. The traffic officer logged and filed several license plates and kept track of the motor vehicles awaiting court order for immobilization, confiscation or return to the owners. As of the last day of the month there were 25 motor vehicles sitting upon the Police Impound Lots. Of the above 25 vehicles several are waiting for court order to dispose of them. ENGINEERING: ANNEXATION: Poets Glen Area Annexation: The petition was filed with Stark county on February 5, 2008. The hearing was held in City Council chambers on April 9, 2008 at 7:00 p.m. The annexation was approved by the Commissioners at their April 9th meeting. The Township has filed an appeal on the Commissioners decision. Approval was denied by Judge Sinclair on July 25th, 2008. The Township has filed an appeal and currently awaiting a ruling. Manson Area Annexation: The petition was filed with Stark county of February 5th, 2008. The hearing was held at the Tuscarawas Township Administrative offices on April 16th, 2008 at 7:00 p.m. The annexation was approved by the Commissioners at their April 16th meeting. The Township has filed an appeal on the Commissioners decision. An oral hearing was held on August 15, 2008 at 8:30 a.m. Currently waiting for the court’s decision. The court has denied the Township’s appeal. Aw aiting to see if the Township appeals to a higher court. BRIDGES: Tremont Avenue Bridge: Detour began February 21st, 2005. The requested federal earmark for this project was denied. A new request was filed through Congressman Regula’s office. ODOT has informed us that they are providing the 20% match for both the Municipal Bridge and SCATS funding. The current estimate for this project is $3.3million. A permit with the Army Corps of Engineers has been secured as was permits from Norfolk Southern & RJ Korman Railroads. Plans have been submitted to ODOT for approval. Anticipated bid opening is in April 2008. AT&T began their relocation work. Bids will be opened May 1, 2008 at the Stark County commissioners office. Bids received were more than 10% over the engineer’s estimate and therefore the project must be re-bid. A request has been submitted to SCATS to increase the City’s portion of the funding. SCATS approved additional funding for the City in the amount of $450,000.00 Also, the County has increased its’ share by the same amount. This project was re-bid and bids were opened July 3, 2008. Beaver Excavating was the successful low bidder with a bid of $3,735,809.67. It is anticipated that work will begin in October 2008. Pre-construction meeting was held September 17, 2008. Norfolk Southern Railroad has approved a temporary crossing and has begun installation. Erie Street Bridge: A pre-bid meeting took place on August 30th, 2007. Project was bid out fall of 2007. The current estimate is $1.8 million. Keffler Construction of Canfield, OH was awarded the contract. Work has begun and is to be completed by October 2008. The bridge will be re-decked, widened to 3 lanes and a sidewalk will be added. The project has been completed and is now open to traffic. Finefrock Road Bridge: Scheduled for re-decking in 2009. City and county resurfacing completed on October 21st, 2006. 32nd Street Bridge Replacement: Survey work has been completed and the design is 100% completed. This project will replace the existing bridge structure with a concrete box culvert. Other components of the project are the relocation of sanitary and storm sewers and street resurfacing within the project limits. OPWC approved the funding request. Project will commence in 2009. SANITARY SEWERS: 2000 WWT Plant Upgrade & Expansion: City is investigating odor control solutions. Tertiary filters have been put on line. The Law Director has entered into contract on behalf of the City with the law firm of Bricker & Eckler LLP to deal with the change orders submitted by Kokosing and also remaining items to complete the contract. A draft of the odor control study has been completed. Final payment has been made to Kokosing. A medication date has been set for May 7th, 2008 in Columbus. A mediation took place at the offices of Bricker and Eckler on May 7th, 2008. Results of the mediation were that the City would settle with Kokosing for an amount of $525,000.00 and would receive back 10% of any net monies Kokosing would obtain from a pending arbitration with CTI. The city received a supplemental loan in the amount of $525,000.00 from the Ohio Water Development Authority which was added to the total current loan amount. 27th Street/Bison Avenue Sanitary Sewer: The design work is 98% completed. This project would be completed to assist the proposed Poets Glen Annexation. Nova Tech Pump Station: This project will replace the existing pump station. The design work is 90% completed. NeoCom Sanitary Trunk Sewer Extension: This project will be tied into the recently constructed South Massillon Trunk Sewer and will serve the northern portion of the NeoCom Industrial Park. The design is 100% completed. This project was submitted to OPWC for funding and was not approved. Seeking other funding sources for construction in 2009. Modified PTI and resubmitted to OEPA for funding and was not approved. Seeking other funding sources for construction in 2009. Modified PTI and resubmitted to OEPA. STREETS: Wales Rd./SR241 Resurfacing: Resurfacing from Lincoln Way to Hills & Dales will be done in 2009 with a grant from ODOT and local funds. 9th Street S.W. Reconstruction: Currently compiling survey data and design work is 40% completed. 2008 Street Resurfacing: Project was out to bid. The bid opening date was August 13th, 2008. Since bids were over 10% of the Engineer’s estimate. The project will be re-evaluated and re-bid. Due to the lack of funds. This project will be re-bid in 2009. 2008 Target Area Street Resurfacing: The bid opening date was August 13th, 2008. Project will be awarded to J.D. Mining, Inc. located in Magnolia, OH. Currently preparing contracts and documents. Pre-construction meeting held September 30th, 2008. Began week of November 3rd, 2008 and completed. Currently preparing punch list. 2008 Lincoln Way W./Lincoln Way E. Project: Bid opening was held on July 30th, 2008. The apparent low bidder was Superior Paving, Inc. with a bid of $254,346.47. Currently preparing contract documents. Pre-construction meeting held September 4, 2008. The paving portion of this project will be completed in the spring of 2009. SUBDIVISIONS: Ballinger Estates: Preliminary plat approved by Planning Commission November 10, 2004. Plans submitted and approved. Sanitary sewer plans approved. Final plat approved by Planning Commission June 22nd, 2005. Council approved July 5th, 2005. Plat recorded. Grading a utility construction completed. Roadway installed week of April 10, 2006. Sanitary Sewer Mapping: 96% completed. SE drawings completed/SD drawings. Permits and GIS are being added to the database and are 18% completed. Editing files to include pipe length and slop/material. GIS: Completed transferring items to ESRI. Setting hyperlinks. Modifying display and addressing and permits, maps. Continuing to update. Keuper Storm Sewer: Scassa Asphalt, Inc. was the apparent low bidder with a bid of $238,999.00. Work began October 6th, 2008. Currently installing pipe. Meeting with Aqua Ohio on water line relocation. Aqua Ohio started water line relocation December 1st, 2008. Outdoor Warning Sirens: Bids were opened June 24th, 2008. American Signal Corporation was the successful low bidder with a bid of $181,692.30. Work began October 2008. Siren installation is completed and currently working on start up. Web Site: The Engineering Department website has been completed and will be update on an ongoing basis. Analyzing and updating current maps.

COMMUNITY DEVELOPMENT: 1. FY 2008 CDBG programs are now underway. The target area street improvements project is under WAY. Sub-recipient agreements with local social service agencies have been executed. As part of the recently passed Housing and Economic Recovery Act of 2008, Congress has appropriated additional HUD funding for a new Neighborhood Strategy Program, which will provide funding to local communities for dealing with foreclosed and abandoned. However, HUD set a minimum funding level of $2 million per community and Massillon did not qualify for a direct grant. Instead, the City will be seeking funding allocated the state of Ohio for this program. These funds can be used for the following activities: 1) purchase & rehabilitation of foreclosed homes; 2) establishment of land banks; 3) demolition of blighted structures; and, 4) redevelopment of vacant or demolished properties. The CD and Housing Directors attended the fall meeting of the Ohio Conference of Community Development (OCCD), which included a substantive briefing on the new NSP Program. Senator George Voinovich attended the NSP seminar and spoke about this program. The Ohio Department of Development also participated in this meeting but made no announcement regarding its proposed distribution of NSP funds. The CD Department is preparing for this program by developing a database of foreclosed and abandoned properties. These can then be mapped to show areas of greatest need for NSP funding. 2. The City is in the process of amending a number of existing enterprise zone agreements at the request of the Stark County Auditor in order to bring these agreements into compliance with County property records. 3. The CD Director also attended the following meetings: *Supporting Student success symposium in Columbus as part of a local contingent representing Massillon City Schools; *Massillon city Planning Commission; *Massillon Public Library Board of Trustees.

HOUSING: The Department received approximately 70 calls and visits regarding Fair Housing Laws and tenant/landlord issues. It was necessary to provide information to numerous tenants and landlords regarding their rights. Several people were referred to Community Legal Aid Services, Inc. for legal advice or other agencies for homeless prevention or financial assistance. This office continues to monitor questionable advertisements listed in the classified section of the local newspaper for possible discrimination. There is currently one housing discrimination complaint filed with the Ohio Civil rights Commission. I participated in a Stark County EITC (Earned Income Tax Credit) Awareness Forum hosted by the Family Economic Success (FES) Program and Stark County Coalition. Guest speakers were representatives from Senator Sherrod Brown’s and Ohio Treasurer’s office who discussed state wide efforts to help eligible taxpayers access the program. Through the EITC Program, free tax preparation service helps low to moderate income families maximize their refunds. FES of Stark County was awarded Federal funding for the first time to help with their efforts. I participated in the Stark County Community Action Agency (SCCAA) Governing Board meeting. The various committees, departments and Executive Director provided reports regarding the agency’s activities. There was a discussion about long lines of HEAP applicants. Applicants who are applying for the program, but not requesting emergency assistance, can apply by mail. Those who are in need of emergency help must do so in person. Additional staff is being hired to help with the problem of long lines. Unfortunately, there are a lot of people in need. Aane Aaby and I met with Will Dent about possibly working with the City regarding the Neighborhood Stabilization Program (NSP). They are very interested. The discussion was preliminary in anticipation of applying for funding from the state of Ohio. I participated in the Western Stark Medical Clinic Executive committee meeting in preparation of a combined November/December meeting. We agreed on policy changes and the budget for consideration at the Board meeting. With funding tight, budget approval is difficult even though need is steadily increasing. I participated in a meeting of the Executive committee of community Building Partnership (CBP) of Stark County. We reviewed the operating support grant applications for various Stark County agencies for the upcoming new year. We agreed on funding amounts for consideration at the quarterly meeting. We also approved next year’s budget. I participated in the Stark County Housing Task Force meeting. Discussed at the meeting were reports regarding the Homeless Collaborative, Save Our Homes (SOH) Coalition and Neighborhood Stabilization Program (NSP) updates. The featured speakers were from Family Economic Success (FES) and Empowering and Strengthening Ohio’s People (ESOP). Our office consistently provides all information gathered to Massillon residents, especially those who are facing difficulty. Four applications were accepted for the Emergency Housing Rehabilitation Program and two contracts were signed. Two projects were completed and two are progressing. One applicant was approved to participate in the Home Buyer’s Assistance Program. The rehabilitation portion for two projects was completed and one project was solicited for bids. Two applicants were approved in November for participation in the full Housing Rehabilitation program, one project was completed and one write up was requested from inspection reports.

SEWER/WASTE COLLECTIONS: Our new customers numbered 29 and we had 20 customers whose service was discontinued. We picked up extra items for customers at 134 locations at an additional cost of $2,245.84. Our new waste packer truck has arrived and has been placed into service in our fleet. It is a welcomed addition. Decisions will have to be made as to the status of our older packers. Most likely, at least one vehicle will be disposed of at the next City Auction. INCOME TAX: Collections were up 13.42% from same time last year. Our total tax collections are up 1.0%. As always, these figures have been balanced with the Auditor’s Office. Employee withholdings were up 15% from same time last year. Business profits were up 38% and taxes received from individuals were down 16%.

Continuing Educations: Mrs. Miller continues to attend classes in the BSN program. A meeting sponsored by Merck was attended, the subject was HPV vaccine. Miscellaneous: Several flu clinics were held at the Health Department and at the senior independent living facilities.

SENIOR CENTER: Activities: *Decorated the Center for Christmas with 4 trees, an abundance of wreaths and good cheer. *Humana held 2 informational meetings here. *Activity van participated in the Holiday Parade. *Nine members attended the Canton Symphony and had lunch out. *Thanksgiving breakfast given for those participating in the MOW program. *Saturday night euchre will suspend play on November 29th until April 4th, 2009. Volunteer Hours: October – 1,262; November - . Director: Attended one SARTA Board Meeting. Attended ribbon cutting for new SARTA station in Alliance. Attended Literacy Commission annual Executive Trivial Pursuit fund raiser.

EEO: I spent a considerable amount of my time reviewing the recent test results that were administered by the Civil Service for the Secretary positions at the Massillon City Schools and the City of Massillon. The 88 candidates that took the test were advised of their scores via mail. There were 35 successful candidates that were certified after careful review. This office has received a number of calls from the citizens of Massillon in regards to employment possibilities with the City. The job scene is very distressful at this time and more jobs are being lost than being created. I am taking advantage of the end of the year slow down and refreshing my files and updating my Equal Employment Opportunity files and changes in Legislation.

FIRE: The Department responded to a total of 281 alarms, this averaging to 9.4 alarms per day. There were 40 fire alarms, 17 public service calls and 224 rescue and EMS calls. The total estimated fore loss was $0.00. There were no injuries due to fires. 11/3/08: I attended the Stark County Haz Mat meeting. 11/4/08: I met with Captain Herrick to review common policies and to begin discussion about a City-wide emergency plan update. 11/6/08: I attended the monthly LOGIC Board meeting. 11/7/08: I met with the Assistant Chiefs to discuss various issues including the upcoming Ohio Quick Clear Law that will impact operations on roadways. I also attended an LEPC Training and Planning Committee
meeting. 11/13/08: I provided a CPR class for Sesame Preschool. 11/17/08: I met with Chief Bailey of Mansfield Fire Department to discuss common issues. 11/21/08: The Department assisted Perry Township Fire Department at a structure fire on Parkland S.W. 11/22/08: The Department participated in the Holiday Parade. 11/26/08: I attended the SCOG Governance Board meeting on Centralized Dispatch. 11/30/08: The annual Firefighter Memorial Service was held. It was well attended and I would like to thank all those who participated. Biannual hose change was completed. The Fire Department is currently undertaking labor negotiations and much time was spent attempting to forge a new labor agreement. A house has possibly become available for multiple training exercises and live –burn training. An area contractor, Mr. Lockhart, has graciously donated a residence on one of his lots to be used for this purpose. Thanks also to Chris Schweier as he researches and reviews how to conduct these types of exercises.
