MAYOR’S MONTHLY REPORT
NOVEMBER 2006

POLICE: Arrests: Total Adult Arrests 55; Total Juvenile Arrests 9; Summons/Citations Issued 22. Incidents: Total Calls 2,054; Security Checks Performed-Residences & Business Locations 272; Incident Cases Reported 102; Crimes Against Property Reported 121; Crimes Against Persons Reported 93; Accident Reports 100; Traffic Citations Issued 300; Alarms 54; Miles of Road Patrol 47,533. Officers: Compensatory Hours Used 296.5; Sick Hours Used 295.0; Personal Hours Used 134.5; Compensatory Hours Earned 901.8; Overtime Hours Earned 341.9.

TRAFFIC CONTROL: The MPD issued a total of 300 traffic citations, this being 153 more than same time last year. The MPD made 10 arrests for DUI, 2 more than same time last year. The MPD handled a total of 99 traffic accidents, this being 15 less than same time last year. There were 62 property damage accidents, 8 injury accidents, 30 accidents that occurred on private property and no fatal accidents. Of the above accidents there were 21 hit-skip accidents, there was 1 accident that occurred as a direct result of alcohol and/or drugs. There were no pedestrian and no bicycle accidents. There were 2 motorcycle accidents. The MPD investigated 5 accidents involving a juvenile that resulted in 1 injury. There were 70 motor vehicles towed by the MPD, this being 7 less than same time last year. Of the above tows, 32 vehicles were towed from traffic accidents, 9 for traffic offenses of some type, 15 as a direct result of an arrest, 10 for parking violations and there was 1 stolen/recovered vehicle and 3 misc. tows. The traffic officer issued 7 parking citations. The traffic officer was able to mail 3 certified letters in regards to junk and/or abandoned motor vehicles. The traffic officer mailed 10 title searches to the State of Ohio, Bureau of Motor Vehicles. The traffic officer was able to junk or title 10 motor vehicles. Further, the officer issued or acted upon 18 notices (48/72 hour and/or 10/20 day notices). Further, the traffic officer sent numerous 2255s and driver’s licenses to the state. The traffic officer logged and filed several license plates and kept track of the motor vehicles awaiting court order for immobilization, confiscation or return to the owners. As of the last day of the month, there were 28 motor vehicles sitting upon the Police Impound Lots. Of the 28 vehicles several are waiting for court order to dispose of them. METERMAID: Total number of tickets issued 190; By parking enforcement 177; By police officers 3; Towed vehicles with tickets 10; Outstanding tickets: 257 (actual count 12-7-06). Total number of PAID violations 128; Number of parking permits issued 224. Revenue received from PAID violations $1,246.00; Revenue received from parking permits $1,925.00; Total Revenue: $3,171.00.

ENGINEERING: ANNEXATION: Hunters Pointe Annexation: Hearing February 8, 2006. Denied by County Commissioners. Re-filed May 26, 2006. Hearing date set for August 16, 2006. Hearing date of August 16, 2006 was canceled by County Commissioners. Owner intends to re-file under a different name. Cottrill Annexation: Filed June 27, 2006. Approved by Commissioners on September 7, 2006. BRIDGES: Tremont Avenue Bridge: Detour began February 21, 2005. The current estimate for this project is $3.5 million. Awaiting for final close out of existing project. Met with the county and the consultant to go over the review of the Stage 1 submittal. At this point, if the project comes in under the estimate, no monies will be spent by the County and City. This project is expected to be bid in October 2007 and begin construction in early spring 2008. Erie Street Bridge: Met with ODOT and SCATS to review the consultant report. Waiting to see if ODOT planning will be able to perform work as a design build in October 2007. Detour discussed, scope-3 lanes, 5’ walkway. Finefrock Road Bridge: Maintenance of surface meetings. Scheduled re-decking for 2008. Reviewing ODOT’s consultant reports. ODOT is accepting public comments on project. City and County resurfacing done in October 21, 2006. US 30 Bridge Project: Working with ODOT and Massillon Park Department for detour preparation. Met with ODOT for easements needed for work. Submitted donation papers. Awaiting asbestos study. Approved maintenance of traffic plan. Ruhlin selected as contractor, scheduled to start work on September 5, 2006. 2006 Bridge Inspections: Will be completed in December of 2006 by Hammontree & Associates. SANITARY SEWERS: 2000 WWT Plant Upgrade & Expansion: Awaiting contractor to finish several items and punch lists items. City is investigating odor control solutions. Investigating fixing more piping. Lincoln Center Phase III-Part B: Requests for Qualifications were received by January 30, 2006. Reviewing and re-evaluating scope. Technical interviews scheduled for May 3, 2006 with 3 firms. Tetra Tech, Inc. was selected to provide engineering and construction management services. Legislation was sent to Council to allow the Safety-Service Director to enter into a contract with said firm. Awaiting amount of funding awarded from Congressman Regula’s office. Various Parking Lot Repairs: Reviewing the following parking lots: Tremont/Erie; Conrad parking lots. Municipal Government Building Parking Lot: Bid opening October 10, 2006. Central Allied low bidder. Began October 16, 2006. 95% completed. 151 Lincoln Way East Improvements: Preparing and designing roadway, walk and building improvements. 100% completed. Bid opening October 5, 2006. Bid received was more than 10% over the engineer’s estimate, therefore this project will be re-bid in the spring. Jail Upgrades: Still awaiting proposals. Working with Captain Herrick. SR241/Tremont Light: ODOT approved grant. 27th/Lincoln Way East: ODOT approved grant. Fire Station No. 1: Foundation settlement problems reviewed with Chief. Met with PCSG. Bid April 3, 2006. No bids received and reviewing options. Plans have been submitted to Plans Examiner for approval and then job will be re-bid September 26, 2006. Bids were opened September 26, 2006. The apparent low bidder is Martindale Foundation Systems, Inc. with a bid of $57,300.00. Construction began the week of October 23, 2006. 75% completed. Ohio Utility Protection/Safety Committee: Next meeting is on November 30, 2006 at Beaver Excavating Co. Municipal Government Building Roofs: Annex building roof contract awarded to Hal Jones, Inc. Work began week of May 22, 2006. Completed and waiting final inspection. SWMP: Submitted revisions Storm Water Management Plan (SWMP) per DEFA request. Awaiting comments. Fixed Asset Report: Updating the Auditor’s data base concerning City owned and maintained infrastructure. Compiling data forward to Auditor. Cherry Street Bridge Rehab: Fix void in Ohio Erie Canal under Cherry Road to be completed by Wenger Excavating. Storm Water Mapping: 65% completed. Sanitary Sewer Mapping: 70% completed.

COMMUNITY DEVELOPMENT: 1. The City continued to implement activities under its FY 2006 CDBG Program. The target area street improvement project is underway. Streets being improved under this program are Oak Avenue S.E. and 1st Street N.E. In addition, the CD Department has been working with Massillon Main Street on a proposed large scale window replacement project for property at 47 Lincoln Way West. Main Street will be requesting additional CDBG funding from the City to assist the property owner in undertaking this much needed project, as the windows in this building are in very poor condition. 2. The City has begun the process of planning for next year’s Community Development Block Grant (CDBG) Program. Notices have been sent to local organizations and the new application form has been posted on the CD Dept. website. An application workshop will be held on December 14 to explain the new procedures. 3. The CD Department is in the process of revitalizing the City’s Historic Preservation Commission, which has been mostly inactive for several years. A portion of the downtown area was designated as a local historic district back in the early 1990’s and the Commission has the authority to review and approve proposed exterior changes to buildings within the downtown historic district. The Commission will be meeting in December to work with Massillon Main Street on the project described above. 4. The CD Director is working with the City Auditor and City Income Tax Office in calculating revenue sharing payments owed the local school districts over the City’s various tax incentive projects. 5. The CD Director participated in the Stark County Regional Planning Commission workshop for FY2007 Federal HOME funding. The City receives an annual allocation of HOME funding from the County for the housing rehabilitation and homebuyer down payment assistance programs operated by the Housing Department. 6. The CD Director attended the following meetings: the Massillon Public Library Board of Trustees, the City Historic Preservation Commission and the Ohio Conference of Community Development Executive Board Meeting.

HOUSING: The Department received approximately 70 calls and visits regarding Fair Housing Laws and tenant/landlord issues. It was necessary to provide information to numerous tenants and landlords regarding their rights. A number of people were referred to Community Legal Aid Services, Inc. for legal advice or other agencies for homeless prevention or financial assistance. This office continues to monitor questionable advertisements listed in the classified section of the local newspaper regarding possible discrimination. I attended a conference regarding the implementation of Ohio’s new Anti Predatory Lending Law. Senate Bill 185 will assist consumers who have been affected by predatory lenders who apply excessive fees, high interest rates and balloon payments to their loans. The information I obtain from Predatory Lending seminars is distributed to all our clients. The session was very informative. I participated in 2 Community Services of Stark County, Inc. (CSSC) meetings. At the Strategic Plan Steering committee meeting, there was an update of the Strategic Plan for the agency that included the annual review and addendum plans and also Committee work for 2007. During the Board of Directors meeting, the CEO reported on fund raising, grants and other activities. I reported for the Long Range Planning Committee. Other committees also reported. The agency continues to provide valuable services to Massillon and all of the Stark County area. I participated in a Family Economic Success meeting. This was a brainstorming and planning session to discuss preparations for funding application. We also discussed goals and objectives of the coalition. The coalition continues to inform low-income families about the upcoming tax preparation season and other financial information. I participated in the Stark County Housing Task Force meeting. Discussed at the meeting were reports regarding housing issues from the Homeless Collaborative, Interagency Council on Homelessness and HUD/Stark Metropolitan Housing Authority. We had a very good roundtable discussion about implementation of Senate Bill 185 (Predatory Lending Law). The Directory of Housing Services of Stark County was briefly discussed. I participated in several Western Stark county Medical Clinic Board meetings. After the Director reported on activities and highlights for the month, other committees also reported. I chair the Nominating Committee and gave an update of new board members scheduled to join the Board. I participated in the Community Building Partnership (CBP) of Stark County meeting. At the Executive Committee meeting we reviewed the budget, program updates, grant review procedures and the calendar of events. Also discussed was a Technical Assistance Program which provides assistance to non-profit community development corporations. This organization continues to support the community development non-profits which are providing housing to low and moderate income residents of Stark County. Much support was provided to ABCD in bring homes to Massillon. I participated in an AHEAD Foundation Board meeting. After discussing general operations of the organization, we reviewed financial reports and budget. We also discussed after school programs and other support services many families received through this very worthy organization. Four applications were accepted to participate in the Home Buyer’s Assistance Program and funds were requested for the down payment for one project. One contract was signed for the rehabilitation portion and one project was completed. Six applications were accepted for the emergency Housing Rehabilitation Program, five projects were completed, four projects were bid and four contracts were signed. One pre-construction meeting was conducted for the full Housing rehabilitation Program, two write up review meetings were held before soliciting bids and a write up for one project was requested.

STREETS: Cold Mix: 5.00 Tons; Swept streets throughout entire City; Continued Leaf Pick-Up Program – picked up 185 dump truck loads and 26 packer loads of bagged leaves; Patched pot holes throughout entire City; Delivered barricades and posted “No Parking” signs for Christmas Parade downtown; Delivered 40 barricades to Stadium for O.H.S.A.A. football playoff games; Removed advertising signs from telephone poles and tree lawns.

SAFETY: Regarding our traffic lights in the City: The Department replaced numerous lights that were burned out and we worked on traffic controllers or flashers throughout the entire City. The Department worked on wiring jobs in the Recreation Center, Senior Center and City Hall. We worked on wiring problems at the City Garage. We worked on wiring at the Legends, Rezzy Fest and the downtown Christmas lights.

SEWER/WASTE COLLECTIONS: Our new customers numbered 30 and we had 22 customers whose service was discontinued. We picked up extra items for customers at 126 locations at an additional cost of $1,210.00. We had five dumpsters placed on a temporary basis. INCOME TAX Income Tax collections were down 1.45% from same time last year. Year to date, tax revenue is still up 1.26% from last year. We are gearing up for “Tax Season”, again. Tax forms are now being printed and will be mailed to all residents the first part of January.

Community Nursing: Field Visits 100; Auxiliary Visits 296. School Visits: Parochial 0; Public 0. Miscellaneous: Two flu clinics were held for Massillon residents at the Recreation Center. A total of 294 were immunized. The nurses also administered flu shots at the Lincoln High Rise, Amherst Meadows, Quarry Ridge, Friendship Village and Riverview, where 133 residents received the vaccine. The Massillon and Canton Health Departments are assisting each other with flu clinics and utilizing the “Swipers” system for registration, maintaining records and billing. The nurses continue to make three visits per week to a TB patient for directly observed therapy.

GOLF COURSE: Golf Revenue/Rounds: Golf revenue figures from the Auditors indicate total golf revenue to be $34,294.00 compared to $54,811.00 same time last year. These figures do not include revenues of $10,201.00 for the last 3 days of the month deposited 11/30 and 12/1/2006. Comparing actual revenue numbers for the calendar period tells us that revenues for 2005 were $42,661.00 while totals for 2006 were $37,750.00. It should be noted that revenues last year included $16,000.00 for two lifetime memberships. Greens and cart fees this month totaled $18,583.00, this being an increase of 38% over last year’s total of $13,471.00 due to mild weather. For the year golf revenues now total $903,260.00 compared to $896,048.00 for last year. We project that December revenues will beat last years and that year end figures will show an increase of roughly 1%. Most of the public golf courses in this area are reporting a decrease in revenues this year as a result of the terrible weather in May and October. Our plan this year was to price ourselves very aggressively to get players back to re-experience The Legends. Golf Course: The contracted tree work on the golf course for the most part has been completed although there is a considerable amount of cleanup work that needs to be done. The fairway aerification process is almost completed with just a few fairways remaining on the east course. The only work left will then be rough aerification. Comments: As the 2006 season draws to a close, we turn our attention to next season. The golf course showed marked improvement this year primarily the result of hiring a qualified, experienced superintendent and upgrading our maintenance and operations staff. The goal next year remains the same….to continue to improve course conditions and the total golf experience at The Legends. This will be a challenge as we plan to operate on a further reduced budget in 2007. At the same time it is paramount that we do everything possible to maximize revenues and operations at The Legends. For the first time in many years, we have a solid year of consistent improvement to build on. This is an important first step as we strive to make The Legends all that it can be.

SENIOR CENTER: Chorus sang at Inn at Belden Village, The Legends and The Landings Nursing Homes; 5 trees were installed at the Senior Center and volunteers decorated and had covered dish luncheons; Harold Leone inducted into the Ohio Veterans Hall of Fame in Columbus. 9 people attended; Volunteers visited Catholic charities day care center and played games; Senior Center van participated in Holiday Parade; Thanksgiving breakfast served in dinning room 11/21/06; Volunteers covered new books at the library. Volunteer hours for October – 1075; Volunteer hours for November – 930. Director: Attended a SARTA Board meeting; Participated in the fund raiser for the Massillon Commission to Advance Literacy.

EEO: On November 8th, this office completed a workforce composition report. The report presented current employment data that details the pertinent information that is required by the Equal Employment Opportunity Commission. This data reveals a trend that is positive for the City’s effort to embrace the concept of diversity in its workforce. One of the charts indicates that in the realm of racial diversity the City employs 86% Caucasians and 13% African American. The most recent U.S. Census reported the racial makeup for the City of Massillon at 88.2% Caucasian and 9.4% African American. Hiring of new full time, non-elected employees improved a great deal this year (2006), with a total of 16. The Departments and gender are: Parks & Recreation - four, two males and two females; Auditor – one , one female; Health Department – two, two females; Economic Development – two, two males; WWT – three, three males; Police Department – three, three males; Fire Department – one, one male. Other efforts by the Department have been directed as selecting the Fire Chief and fire Captain for the City of Massillon.

LATE REPORT

OCTOBER 2006

FIRE: The Department responded to a total of 287 alarms. This averages to 9.25 alarms per day. There were 54 fire alarms, 28 public service calls and 235 rescue and EMS calls. The total estimated fire loss for the month was $46,400.00. On the 5th I attended the monthly LOGIC Board meeting. The week of the 8th was the National Fire Prevention Week. During the week the Fire Prevention Bureau had presentations at various locations. Martindale Foundation Systems, Inc. began work on Station No. 1 on the 10th. Midwest Underground Technologies gave classes on trench rescue to our personnel on the 11th, 12th and 16th with our new trench rescue equipment. Captain Layne and I attended the annual L.E.P.C. conference on the 13th held at the Foltz Community Center in East Canton. Promotional testing for the positions of captain and chief by the Ohio Fire Chiefs’ Association were held on the 25th with 21 personnel taking the captain’s test and 4 taking the chief’s test. We provided a fire truck for the annual Massillon/McKinley parade and supervised the bonfire on the 27th.
