MAYOR’S MONTHLY REPORT

POLICE: Arrests: Total Adult Arrests 65; Total Juvenile Arrests 10; Summons/Citations Issued 18. Incidents: Total Calls 1,931; Security Checks Performed-Residences & Business Locations 171; Incident Cases Reported 92; Crimes Against Property Reported 139; Crimes Against Persons Reported 93; Accident Reports 97; Traffic Citations Issued 165; Alarms 126; Miles of Road Patrol (Mileage from previous month) 28,290. Officers: Compensatory Hours Used 76.7; Sick Hours Used 129.5; Personal Hours Used 91.0; Compensatory Hours Earned 451.5; Overtime Hours Earned 177.7.

TRAFFIC CONTROL: The MPD issued a total of 165 traffic citations, this being 22 more than same time last year. The MPD made 13 arrests for OVI, this being the same as same time last year. Radar citations totaled 13, this being 9 more than same time last year. The MPD handled a total of 88 traffic accidents, this being 22 less than same time last year. There were 46 property damage accidents, 15 injury accidents, no fatal accidents and 28 accidents that occurred on private property. Of the above mentioned accidents, there were 15 hit-skip accidents and there were 6 accidents that occurred as a direct result of alcohol and/or drugs. There were 0 motorcycle and 2 pedestrian accidents. The MPD investigated 15 accidents involving juveniles resulting in 3 reported injuries. There were 88 motor vehicles towed by the MPD, this being 4 less than same time last year. Of the above mentioned tows, 28 vehicles were towed from traffic accidents, 10 for traffic offenses of some type, 15 as a direct result of an arrest and 4 for parking violations, one recovered stolen vehicle and one miscellaneous tow. The traffic officer mailed 9 certified letters in regards to junk and/or abandoned motor vehicles. The traffic officer mailed 8 title searches to the State of Ohio, Bureau of Motor Vehicles. The traffic officer was able to junk or title 8 motor vehicles. The traffic officer issued or acted upon 17 notices (48/72 hour and/or 10/20 day notices). The traffic officer sent numerous 2255s and driver’s licenses to the state. The traffic officer logged and filed several license plates and kept track of the motor vehicles awaiting court order for immobilization, confiscation or return to the owners. The traffic officer issued 5 parking citations. As of the last day of the month there were 23 motor vehicles sitting upon the Police Impound Lots. Of the 23 vehicles, several are waiting for court order to dispose of them. METERMAID: Total number of tickets issued 142; By parking enforcement 133; By police officers 4; Towed vehicles with tickets 5; Outstanding tickets 484. Total number of PAID violations 100; Number of parking permits issued 252. Revenue received from PAID violations (including hearing fees) $1,000.32; Revenue received from parking permits $1,610.00; Total Revenue: $2,610.32.

ENGINEERING: ANNEXATION: Poets Glen Area Annexation: The petition was filed with Stark County on February 5, 2008. The hearing was held in City Council Chambers on April 9, 2008 at 7:00 p.m. The annexation was approved by the commissioners at their April 9th meeting. The Township has filed an appeal on the Commissioners decision. Approval was denied by Judge Sinclair on July 25th, 2008. The Township has filed an appeal and currently awaiting a ruling. BRIDGES: Tremont Avenue Bridge: Detour began February 21st, 2005. The requested federal earmark for this project was denied. A new request was filed through Congressman Regula’s office. ODOT has informed us that they are providing the 20% match for both the Municipal Bridge and SCATS funding. The current estimate for this project is $3.3 million. A permit with the Army Corps of Engineers has been secured as was permits from Norfolk Southern & RJ Korman Railroads. Plans have been submitted to ODOT for approval. Anticipated bid opening is in April 2008. AT&T began their relocation work. Bids will be opened May 1st, 2008 at the Stark County Commissioners office. Bids received were more than 10% over the engineer’s estimate and therefore the project must be re-bid. A request has been submitted to SCATS to increase the City’s portion of the funding. SCATS approved additional funding for the City in the amount of $450,000.00. Also, the County has increased its’ share by the same amount. This project was re-bid and bids were opened on July 3rd, 2008. Beaver Excavating was the successful low bidder with a bid of $3,735,809.67. It is anticipated that work will begin in March 2009. Preconstruction meeting was held September 17th, 2008. Norfolk Southern Railroad has approved a temporary crossing and has begun installation. Beaver has started construction on March 2, 2009. Finefrock Road Bridge: Scheduled for re-decking in 2009. City and County resurfacing completed on October 21st, 2006. Preconstruction meeting is set for April 7th, 2009. 32nd Bridge Replacement: Survey work has been completed and the design is 100% completed. This project will replace the existing bridge structure with a concrete box culvert. Other components of the project are the relocation of sanitary and storm sewers and street resurfacing within the project limits. OPWC approved the funding request. Project will commence in 2009. Currently preparing bid documents. Aqua Ohio will be relocating a portion of waterline in May of 2009. SANITARY SEWERS: 2000 WWT Plant Upgrade & Expansion: City is investigating odor control solutions. Tertiary filters have been put on line. The Law Director has entered into contract on behalf of the City with the law firm of Bricker & Eckler LLP to deal with the change orders submitted by Kokosing and also remaining items to complete the contract. A draft of the odor control study has been completed. Final payment has been made to Kokosing. A mediation took place at the offices of Bricker & Eckler on May 7th, 2008. Results of the mediation were that the City would settle with Kokosing for an amount of $525,000.00 and would receive back 10% of any net monies Kokosing would obtain from pending arbitration with CTI. The City received a supplemental loan in the amount of $525,000.00 from the Ohio Water Development Authority which was added to the total current loan amount. The City is seeking compensation from the tertiary filter manufacturer in order to optimize the filters. A trial is set to take place in the spring of 2009. 27th Street/Bison Avenue Sanitary Sewer: The design work is 98% completed. This project would be completed to assist the proposed Poets Glen Annexation. Nova Tech Pump Station: This project will replace the existing pump station. The design work is 90% completed. NeoCom Sanitary Trunk Sewer Extension: This project will be tied into the recently constructed South Massillon Trunk Sewer and will serve the northern portion of the NeoCom Industrial Park. The design is 100% completed. This project was submitted to OPWC for funding and was not approved. Seeking other funding sources for construction in 2009. OEPA has approved the PTI. State Avenue Sewer Rehab: Beginning survey and preliminary design work on replacing a portion of the sanitary sewer. The design work is 40% completed. STREETS: Wales Rd./SR241 Resurfacing: Resurfacing from Lincoln Way to Hills & Dales will be done in 2009 with a grant from ODOT and local funds. 9th Street SW Reconstruction: Currently compiling survey data and design work is 50% completed. 2008 Street Resurfacing: Project was out to bid. The bid opening date was August 13, 2008. Since bids were over 10% of the engineer’s estimate, the project will be re-evaluated and re-bid. Due to the lack of funds, this project will be re-bid in 2009. 2008 Target Area Street Resurfacing: The bid opening date was August 13, 2008. Project will be awarded to J.D. Mining, Inc. located in Magnolia, OH. Currently preparing contracts and documents. Preconstruction meeting held September 30, 2008. Began week of November 3, 2008 and completed. Punch list items will be completed in the spring of 2009. 2008 Lincoln Way W/Lincoln Way E Project: Bid opening was held on July 30, 2008. The apparent low bidder was Superior Paving, Inc. with a bid of $254,346.47. Currently preparing contract documents. Preconstruction meeting held September 4, 2008. The paving portion of this project will be completed in the spring of 2009. Expecting Superior to start manholes and catch basins in April 2009. Main Avenue Resurfacing: Resurfacing plans 100% completed. The city has received money as a result of the stimulus package for this project. This project will be constructed in early 2010. SUBDIVISIONS: Ballinger Estates: Preliminary plat approved by Planning Commission November 10, 2004. Plans submitted and approved. Sanitary sewer plans approved. Final plat approved by Planning Commission June 22, 2005. Council approved July 5, 2005. Plat recorded. Grading and utility construction completed. Houses are completed. Roadway installed week of April 10, 2006. Punch list items completed. Released to City October 20, 2008. Ballinger Estates Phase 2: Preliminary plat approved by Planning Commission December 13, 2006. Gas line relocation started January 5, 2009. Water line and gas line relocation completed. Waiting for the contractor to resume work. Contractors resumed work February 9, 2009. Currently installing pipe. Project set to be completed by completed by May 2009. Outdoor Warning Sirens: Bids were opened June 24, 2008. American Signal Corporation was the successful low bidder with a bid of $181,692.30. Work began October 2008. Siren installation is completed and functioning. Currently completing punch list items. WebSite: The Engineering Department website has been completed and will be updated on an ongoing basis. Analyzing and updating current maps.

COMMUNITY DEVELOPMENT: 1. The City has prepared a proposed budget for the FY2009 CDBG Program. However, the City does not yet know its FY2009 block grant allocation, but anticipates that its CDBG grant will be similar to last year’s. In addition, as part of the Federal Government’s Stimulus Program, the City will be receiving an additional $195,062.00 in CDBG funding to be used for projects that can get underway within 120 days. This funding will be provided through an amendment to the City’s current FY2008 CDBG Program. 2. The City is awaiting notification from the state regarding our application for Neighborhood Strategy Program (NSP) funding. The NSP Program will provide funding to local communities for dealing with foreclosed and abandoned properties. Massillon has been allocated $1,578,149.00 in NSP Funding by the state. This money will be used for the following activities: 1) purchase & rehabilitation of foreclosed homes; 2) establishment of land banks; 3) demolition of blighted structures; and, 4) redevelopment of vacant or demolished properties. 3. The CD Department completed and filed with the state the annual report on the enterprise Zone Program. This report provides information on all tax abatement projects, including project investment, job creation and retention. This report will be submitted to the City’s Tax Incentive Review Committee, then to City Council. 4. The CD Department has submitted for Council review and approval a proposal to reestablish the City’s downtown Community Reinvestment Area (CRA). Under the CRA, the City will be able to offer tax incentives to encourage rehabilitation and redevelopment of structures within the designated area. 5. The CD Director met with the local representative of the Bureau of the Census regarding plans to build awareness and promote participation in the upcoming 2010 Census. 6. The Department worked with the Police Department on an application to the Federal Government for stimulus funding under the COPS Hiring Recovery Program, which provides 100% funding to prevent lay-off of police officers.

HOUSING: The Department received approximately 70 calls and visits regarding Fair Housing Laws and tenant/landlord issues. It was necessary to provide information to numerous tenants and landlords regarding their rights. Several people were referred to Community Legal Aid Services, Inc. for legal advice or other agencies for homeless prevention or financial assistance. This office continues to monitor the classified section of the local newspaper in order to seek questionable advertisements for possible discrimination. The Department submitted a complaint to the Ohio Civil Rights Commission regarding discrimination due to the tenant’s race, color and her disability. I participated in the regular meting of the Family Economic Success (FES) of Stark County Coalition. Discussed at the meeting were 2010 budget, goals of the organization, 2008 tax season and FES updates which included the National Super Saturday scheduled for the end of March. I participated in the FES Advisory Meeting prior to the regular meeting. Later in the month, I participated in a meeting with the director of Community Legal Aid to discuss the process of becoming an independent 501.c3 organization. I also participated in a strategic planning meeting to discuss funding, budget, goals, VITA office locations and growth of the Coalition. I met with a local developer about his desire to utilize City Home Buyer’s Assistance funding to assist buyers of affordable housing he may develop. He will meet with lenders and others to decide if he should proceed. Aane Aaby and I met with the director of Community Building Partnership (CBP) to discuss how an upcoming visit by a neighborhood strategist could help Massillon. CBP is sponsoring the visit to Stark County. Massillon’s participation will consist of working with ABCD and a visit to the Massillon Homes Development. I participated in the Western Stark Medical Clinic (WSMC) Board of Directors meeting. The President, various committees and staff provided reports. As Chairperson of the Nominating Committee, I conducted a meeting in preparation of the Board Meeting and upcoming election. The Clinic’s services are needed during these difficult economic times due to citizens losing their jobs and medical insurance. I participated in a Stark county Community Action Agency (SCCAA) Governing Board meeting. The various committees, departments and Executive Director provided reports regarding the agency’s activities. The strategic plan was also discussed during the meeting. The numerous programs offered through this agency are valuable to the community. A meeting was scheduled for me to meet with the Executive Director and the Home Weatherization Assistance Program (HWAP) Director to help increase services to Massillon residents. The Fair Housing Board met. At the meeting questions were answered regarding the Department’s monthly reports. A new Fair Housing complaint was discussed based on race, color and handicap. The progress of an existing complaint was also discussed. Fair Housing month activities were discussed. The problem of foreclosure was also discussed, as well as, resources available to homeowners to help resolve this problem. I participated in the Stark County Housing Task Force meeting. Reports from the Homeless Collaborative and a financial fair recently conducted were provided. A representative from Stark Metropolitan Housing Authority reported on waiting list information and developments under consideration. There was also an update regarding NSP funding and plans provided by representatives from Stark County Regional Planning and the cities of Massillon and Canton. I participated in the AHEAD Foundation Board meeting. The Director gave financial updates and reported on other activities. Goals, activities and finances for the upcoming year were also discussed. I participated in the Stark County Housing Trust Fund (SCHTF) Board meeting. After reviewing reports and activities for the committee, we discussed a pending contract to hire someone to search for available dedicated funding sources. After the discussion, it was decided that we would meet with the consultant prior to making a decision about executing a contract. As a member of the Stark County Interagency Council on Homelessness (SCHTF) Evaluation Committee, I participated in a meeting to discuss changes in grant requirements and to set a schedule to review grants. I met with representatives from Stark county Community Action (SCCAA) to discuss their Home Weatherization Assistance Program (HEAP). SCCAA received stimulus funding to increase their weatherization efforts. Our office is contacting eligible homeowners in an effort to make the program more accessible to Massillon residents. Kitty Yingling and I attended a Tenant/Landlord Workshop sponsored by Stark County Fair Housing. A sanitarian with the Stark County Health Department spoke about mold and other health related issues. The Tenant Outreach Coordinator for the Coalition on Homelessness and Housing in Ohio (COHHIO) spoke about Tenant/Landlord Law. He also informed us about House Bill 9 which will help protect tenants who reside in a property that is subject to foreclosure. Both speakers were very interesting and answered questions from the audience. Four Emergency Housing Rehabilitation inspections were requested upon approval of the applicants, three projects were completed and one is progressing. Four applicants were approved to participate in the Home Buyers Assistance Program. Inspections were requested for one full Housing Rehabilitation and one contract was signed after a preconstruction meeting was held.

Patched streets throughout entire City; Cleaned off catch basins throughout entire City; Swept streets throughout entire City; Removed advertisement signs from tree lawns and telephone poles throughout entire City; Ice and snow control throughout entire City; Cleaned out debris from drainage pipe in ditch at Stratford and Dexter N.E.; Worked with Ohio Edison to dig up buried electric cable and install 60’ conduit at Keuper N.E. near Amherst Shopping Center.

SEWER/WASTE COLLECTIONS: Our new customers numbered 30 and we had 31 customers whose service was discontinued. We picked up extra items for customers at 179 locations at an additional cost of $1,648.00. INCOME TAX: Collections were down 4.28%, from same time last year. Our total tax collections are up 3.01%. As always these figures have been balanced with the Auditor’s Office. Employee withholdings were up 11.28%, from same time last year. Business profits were down 56.93%, from same time last year. Taxes received from individuals were up 3.79%, from same time last year.

GOLF COURSE: Golf Course Maintenance: 1. Course Preparation: The crew has been working on getting the golf course ready since March 15th. We are still limiting the number of employees due to the weather. Already had the opportunity to cut the whole course and start the fertilization of the greens and tee boxes. 2. The Replacement Tent: Was installed and completed late in the month, this was replaced due to the wind storm that we had. Insurance picked up. 3. New in 2009: Installed three water coolers on the course for the golfers. ClubHouse: 1. Course opened on March 15th and we have had a great month as it relates to tee times and financially. 2. Pro-Shop: Is up and functioning really well for this early in the year. We were able to move last year’s entire inventory and replace it with new items. 3. Staffing: All the staffing for the ClubHouse has been hired, trained and started their service. Staff meetings have taken place. 4. Outings: Added two (2) more outings to the yearly total. 5. Season Passes: We have sold 61 annual passes. Miscellaneous: 1. Met with Club Legends and they are still wanting to work out a contract for the Parks and Recreation to take over the food service contract even prior to the season ending. We have had very good conversations and both sides are trying to work out the financial details.

SENIOR CENTER: Activities: *Volunteers (VISTA) assisting with income tax filing for seniors and low-income families. (E-File). *Committee met to plan Massillon Area Senior Citizens Day on May 12th. *Van trip for lunch and to Canton Symphony Orchestra, Canton Museum of Art and the Kimono display. *March is Women’s History Month and a Brunch was held with 48 people present. Omelets in a bag were prepared, fruit and muffins. Margy Vogt entertained us with stories of local women of history. Volunteer Hours: February – 868; March – 909.5.

EEO: The EEO Director worked with the Civil Service Commission to wrap up the examination of the position of Head Nurse. Due to the recent retirement of Barbara Miller, the Massillon Health Department advertised, interviewed (3/2/09) and selected Diana Martin for the open position. Diana received the position effective March 30, 2009. Diana has devoted 10 years of service to the Health Department in the position of WIC Supervisor. (Congratulations Diana on your new position.) The EEO Officer attended the Civil Service meeting on Tuesday, March 10th and was informed of the need for a WIC Supervisor in the Health Department. Arrangements have been made to advertise and select a Supervisor to fill this open position.
